Terms of Use
These Terms of Use are an agreement between you and the operator of the Camehere website at camehere.netlify.app ("Camehere," "we," "us"). They apply to the website, its personal map and journal, cloud connections, friends features, and public leaderboard (the "Service"). Read them and the Privacy Notice before accepting. You may save or print a copy. The operator can be contacted through our contact and reporting form.
1. Eligibility and affirmative acceptance
You must be at least 18 years old and legally able to enter this agreement. Do not use the Service if you do not meet both conditions. The Service is an adult personal journal, not a service for children. Checking the acceptance boxes and selecting the clearly labeled accept button signifies agreement to this version of the Terms and acknowledgment of the Privacy Notice. Visiting a legal or contact page alone does not signify acceptance. An age checkbox is a self-declaration; it is not an identity or age-verification service.
2. What the Service does—and does not do
Camehere lets you record your own places, counts, headcounts, dates, notes, photos, and preferences. Counts and leaderboard entries are user-reported, not independently verified. A pin is not proof that an event happened, that anyone consented, that a person was present, or that you have permission to access property. The Service provides no medical, mental-health, legal, emergency, navigation, or professional advice. It is not a dating, matchmaking, emergency-response, surveillance, or identity-verification service.
3. Consent, lawful conduct, and personal safety
You are responsible for your conduct, your content, and your choices about places you visit. Use the Service only for lawful, consensual adult experiences. Obtain permission where needed to photograph, record information about, or disclose information concerning another person. Do not identify or expose another person's intimate life without their express authorization. Recording a count never substitutes for consent, and consent can be withdrawn.
Do not trespass, enter restricted or dangerous areas, use the Service while driving or operating machinery, or violate public-conduct, photography, privacy, or other applicable rules. Rankings confer no prize or instruction to take risks. Verify access rights, conditions, and coordinates independently. If someone is in immediate danger, contact appropriate emergency services; the Service and reporting form are not monitored emergency channels.
4. Prohibited content and misuse
You must not submit nude or sexually explicit images; any sexual content involving minors; nonconsensual intimate material; content promoting exploitation, trafficking, coercion, or abuse; threats, harassment, stalking, doxxing, discrimination, defamation, or unlawful disclosure; or material that infringes intellectual-property or privacy rights. Do not impersonate people, disclose another person's identity in a public nickname, fabricate entries to harass or deceive, create accounts to manipulate rankings, or imply that we endorse you.
Do not access others' accounts, bypass access controls, distribute malware, attack or overload the Service, harvest identities, or scrape information for profiling or surveillance. Lawful security research, lawful speech, regulatory complaints, and rights that cannot lawfully be restricted are not prohibited by these Terms.
5. Your accounts and devices
Puter provides optional sign-in and cloud storage under its own terms. Use an account you are authorized to use, protect your device and credentials, and report suspected compromise. You are responsible for activity you authorize and for taking reasonable security precautions, but these Terms do not make you responsible for conduct or losses that applicable law assigns to us or another party. We cannot recover your Puter account or an unknown device-lock passphrase.
6. Your content and the limited permission you grant
You retain your rights in your content. You represent that you have the rights and permissions required to use it here. You grant us a nonexclusive permission to store, transmit, reproduce, and technically process content only as reasonably needed to provide the features you request, maintain security, resolve reports, and meet legal obligations. Photos may be resized and converted to JPEG. We do not acquire ownership of your photos or personal memories.
If you separately opt into the leaderboard, you authorize public display of your chosen name, aggregate count, number of pins, public entry identifier, and update time. That permission is limited to your public entry; it does not authorize us to publish private pin details. You may remove your entry using the Service or request assistance. Removing it stops our ongoing publication when processed, but cannot recall copies, screenshots, or caches created by other people. Limited retention for backups, disputes, security, or legal obligations may continue as described in the Privacy Notice and permitted by law.
7. Public leaderboard
Participation is optional and requires a separate unchecked sharing confirmation. Public totals are snapshots you deliberately publish and do not automatically follow every private edit. Totals may be incomplete, inaccurate, unavailable, or manipulated despite safeguards. Do not rely on rankings as evidence about a person's conduct, character, health, consent, or relationships. We may correct, hide, or remove entries reasonably suspected of violating these Terms, presenting safety or privacy risks, or violating law, and may limit abusive accounts. We do not promise to review every entry before publication.
Friends and pin activity
Friends are optional and require a mutual connection. Friend codes let another signed-in user send a request and see the nickname associated with that request; codes are not passwords. Only share a code with people you wish to connect with. You may decline requests, remove friends, or block accounts.
Sharing new-pin activity and receiving in-app pin notifications are separate settings, both off by default. If you enable sharing, current friends can see your nickname and that a new pin was added, with the time of the update. Private pin details are not included. Activity is self-reported and is not proof of conduct or consent. Only new pins saved while the friends connection is active produce alerts; edits, imports, and earlier pins do not. Alerts can be delayed, missed, or duplicated by connectivity or software problems. They appear inside the open, unlocked app, not as phone push or email notifications. Removing or blocking a connection stops future access through that relationship but cannot recall copies already seen or saved. Do not use requests or activity to harass, monitor, pressure, or identify someone without permission.
8. Storage, backups, privacy lock, and data loss
Device-only data can be lost if browser storage is cleared, a device is lost, storage is full, or software fails. Make and safeguard independent backups. A cloud connection can fail; check the displayed save status. Copies on other devices, in Puter, or in exported files have separate lifecycles.
The optional device lock encrypts the saved browser copy and backups exported while the lock is enabled. It does not encrypt the separate Puter cloud copy, protect an unlocked session, remove identifying details visible in a photo, or guarantee protection against a compromised device, account, browser, or third-party code. There is no passphrase-reset mechanism for those encrypted copies. A lost passphrase can make them inaccessible. These disclosures do not waive any security or data-protection duty we owe under applicable law.
9. Maps, search, location, and outside services
Satellite imagery, addresses, geocoding, GPS positions, and map boundaries may be inaccurate, outdated, unavailable, or approximate. Device location is requested when you choose the location feature and is subject to browser permission. Outside services—including Netlify, Puter, Esri and its imagery contributors, Photon/OpenStreetMap, and font and code providers—have their own terms, privacy practices, outages, restrictions, and potential charges. Their policies do not replace duties we independently owe you. Keep required map and data attributions intact.
10. Availability, changes, and termination
The Service is currently offered without a Camehere subscription fee. Any future paid feature requires a separate clear offer and acceptance; these Terms do not authorize a future charge. We may reasonably change, suspend, or discontinue features for maintenance, security, legal requirements, abuse prevention, or operational reasons. Where practicable and required by law, we will provide appropriate notice and an opportunity to retrieve available content. Urgent safety or legal action may require immediate restriction. You may stop using the Service at any time; use the deletion and export controls or contact form for available assistance.
11. Service ownership
Except for your content and third-party materials, we or our licensors retain rights in the Service's code, design, and branding. We grant you a limited, revocable, nonexclusive permission to use the Service as intended while complying with these Terms. No ownership transfer or permission to impersonate Camehere is granted. Third-party and open-source licenses remain applicable.
12. Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, AND WITHOUT A GUARANTEE OF UNINTERRUPTED OPERATION, ACCURACY, SECURITY, OR RECOVERY. We do not exclude express commitments we actually make, or statutory guarantees and remedies that cannot lawfully be excluded. This section does not excuse fraud or misleading representations.
13. Limits on liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAMEHERE AND ITS OPERATOR ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM USE OF OR INABILITY TO USE THE SERVICE. TO THAT SAME EXTENT, OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF US$100 OR THE AMOUNT YOU PAID CAMEHERE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits apply only where lawful. They do not limit liability for our fraud, intentional misconduct, gross negligence, death or personal injury where exclusion is prohibited, or any liability, consumer remedy, or privacy right that cannot lawfully be limited. They do not release third parties from their own duties. If a limit is unenforceable, the applicable mandatory legal standard applies instead.
14. Responsibility for third-party claims
To the extent permitted by law, you agree to reimburse us for reasonable losses and costs resulting from a third-party claim to the extent caused by your unlawful content, infringement of another person's rights, or intentional or materially wrongful violation of these Terms. This obligation does not cover losses caused by our own wrongful acts or matters for which liability cannot lawfully be shifted. We will provide reasonable notice and cooperation. No settlement requiring your admission, payment, or nonmonetary obligation may be made on your behalf without your consent, not unreasonably withheld.
15. Reports, privacy requests, and disputes
Use the contact and reporting form for privacy or safety concerns, infringement reports, access or deletion requests, or disputes. Include enough information to locate a public entry, but do not send passwords, intimate images, or unnecessary personal details. We may request proportionate verification before acting on account or data requests. You may also contact the relevant provider, authority, regulator, or a court where appropriate.
These Terms do not impose mandatory arbitration, a class-action waiver, an exclusive forum, or a shortened statutory claim period. Disputes are subject to the laws and courts having jurisdiction under applicable law, including mandatory protections where you reside. Nothing restricts your right to report unlawful conduct, contact regulators, or obtain nonwaivable remedies.
16. Changes, records, and general provisions
We identify each version by its effective date and version number. Material changes will be presented for affirmative acceptance before continued use of affected features; new terms do not retroactively extinguish accrued rights. A posted revision alone is not agreement to materially changed terms. You can review, print, or save this version and the Privacy Notice without signing in. We record the accepted version and time as described in that notice.
If a provision is invalid, the remaining provisions apply to the extent they can lawfully operate independently. Failure to enforce a provision immediately does not waive it. These Terms and any separate express agreement concerning the Service comprise the agreement on this subject; they do not override mandatory law or another person's independent rights. Obligations that reasonably need to continue after use ends—including accrued payment obligations, limited content retention, lawful liability limits, and dispute provisions—survive only to the extent lawful.
Optional Camehere Plus purchases
Plus is an optional one-time digital upgrade for additional themes and personal statistics. Purchases are available only when checkout is enabled. Review the currency, total, and any taxes shown in checkout before paying. A one-time purchase does not authorize recurring charges. Existing Free features, including privacy controls, remain available without Plus.
Use the same permanent Puter account for checkout and restore. Access is granted after server verification of successful payment and may require an internet connection for subsequent checks. Do not purchase again merely because verification is delayed; use restore or contact support. A refund, reversal, or disputed payment may suspend Plus access while reviewed; your Free journal features and memories remain available. Contact the operator through the contact form for purchase problems or refund requests. Mandatory cancellation, refund, and other consumer rights remain unaffected. A one-time price does not promise that the Service will operate forever.
